Terms of Service

1. Who May Use Bubsby

You must be at least 18 years old, or the age of majority in your location if higher, to create a Bubsby account.

Bubsby is designed for adults and caregivers. Children are not intended to create accounts or use Bubsby directly without adult involvement. If you add information about a child, household member, caregiver, school, activity, or other person, you confirm that you have appropriate authority to do so.

You are responsible for keeping your login credentials secure and for all activity under your account, except where caused by our breach of these Terms or applicable law.

2. What Bubsby Does

Bubsby is a household organisation and personal assistant service. The Service may include task, event, reminder, note, email intake, calendar, household sharing, caregiver coordination, birthday, shopping, recipe, document, photo, OCR, voice/text capture, AI-assisted extraction, notifications, support, billing, analytics, diagnostics, and related account features.

Bubsby is a planning and organisation tool. It is not a substitute for your own judgement, professional advice, school communications, medical advice, legal advice, financial advice, or emergency services.

3. Accounts and Household Access

You agree to provide accurate account information and keep it up to date. If you create, join, or administer a household, you are responsible for inviting only people who should have access, removing access when appropriate, and choosing what to share.

Household members may see shared household data according to their role and permissions. Some household content may remain available to the household after a member leaves if it was created for shared household use.

4. Subscriptions, Trials, Billing, and Renewals

Some Bubsby features may require a paid plan. Plan features, pricing, billing periods, trial terms, renewal dates, and cancellation options will be shown before purchase or in the relevant app store or checkout flow.

Paid plans may renew automatically unless cancelled before the renewal date. You are responsible for cancelling before renewal if you do not want the next charge.

• purchases through Apple are billed and managed by Apple under Apple's terms
• purchases through Google Play are billed and managed by Google under Google's terms
• purchases through our website may be billed by Stripe or another payment provider
• cancellation, refund, and renewal settings may need to be managed through the platform where you subscribed

Unless required by applicable law or stated in the checkout flow, fees are non-refundable once charged. This does not limit any rights you may have under consumer laws in your country, state, province, or territory.

We may change plan features or prices in the future. If a change materially affects you, we will provide notice as required by law or platform rules.

5. Email, Calendar, and Connected Services

You may choose to connect or configure email, calendar, and other third-party services. You confirm that you have authority to connect the account or forward content to Bubsby, understand Bubsby may process connected or forwarded content, and understand third-party provider terms and privacy policies also apply.

For email intake, Bubsby may process forwarded emails, connected Outlook mail, sender settings, attachments, and related metadata so that emails can be reviewed and turned into household items only where appropriate.

For calendar features, Bubsby may read calendar details, identify conflicts, create events, update events, or hand off events depending on the feature, platform, and permission you choose. You remain responsible for checking important emails, calendars, school notices, appointments, deadlines, and reminders.

6. AI, Automation, and Review

Bubsby may use AI and automation to extract, classify, summarise, or suggest information from content you provide or connect. AI outputs may be incomplete, delayed, or wrong.

You are responsible for reviewing important outputs before relying on them. Bubsby does not guarantee that it will detect every date, conflict, event, task, assignment, reminder, child, sender, attachment, or relevant detail.

Bubsby is not designed to make legal, medical, financial, employment, housing, credit, emergency, or similarly significant decisions.

7. Your Content

You retain ownership of content you add to Bubsby or connect to Bubsby. You grant Bubsby a limited licence to host, store, copy, process, transmit, analyse, display, and create derived outputs from your content only as needed to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.

You confirm that you have the rights and authority needed to upload, forward, connect, or share your content through Bubsby.

8. Acceptable Use

You must not use the Service unlawfully or deceptively; upload content without authority; harass, abuse, threaten, exploit, or harm anyone; access systems without permission; interfere with or scrape the Service; bypass security, rate limits, payment controls, plan limits, or access restrictions; upload malware; reverse engineer the Service except where law allows it; use bots without permission; misuse AI features; or use Bubsby to build a competing product.

9. Privacy

Our Privacy Policy explains how we collect, use, share, store, and protect personal information. By using Bubsby, you acknowledge our Privacy Policy.

10. Intellectual Property

Bubsby and its software, designs, features, names, logos, trademarks, text, graphics, workflows, and other materials are owned by us or our licensors and are protected by intellectual property laws.

Except for your content, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless we give written permission or applicable law allows it.

11. Feedback

If you send ideas, feedback, bug reports, or suggestions, you allow us to use them without restriction or compensation to improve Bubsby. This does not give us ownership of your underlying household content.

12. Service Availability and Changes

We aim to keep Bubsby reliable, but we do not guarantee uninterrupted, error-free, or always-available service. We may modify, suspend, or discontinue features where needed for product, operational, legal, security, or business reasons.

Third-party services, app stores, email providers, calendar providers, hosting providers, AI providers, payment providers, and device platforms may affect the Service in ways outside our control.

13. Support, Security, and Account Deletion

Support is available through the app or by contacting info@bubsby.com. You can delete your account in the app from Settings > Delete account, visit https://bubsby.com/delete-account, or contact us.

14. Disclaimers

To the maximum extent permitted by law, Bubsby is provided on an "as is" and "as available" basis.

We do not promise that the Service will meet every need, be uninterrupted, secure, or error-free, or that AI suggestions, reminders, classifications, conflict checks, emails, calendar events, notifications, integrations, or extracted details will always be accurate or timely.

You remain responsible for checking important household, school, calendar, health, travel, financial, legal, and safety-related information through appropriate primary sources.

16. Limitation of Liability

To the maximum extent permitted by law, Bubsby and its officers, employees, contractors, suppliers, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, or expected savings.

To the maximum extent permitted by law, our total liability for claims relating to the Service or these Terms is limited to the greater of the amount you paid to Bubsby in the 12 months before the claim or AUD $100. These limits do not apply where liability cannot legally be limited.

17. Indemnity

You agree to indemnify Bubsby against claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, breach of these Terms, content you upload or share without appropriate authority, or violation of another person's rights or applicable law. This applies to the extent permitted by law.

18. Suspension and Termination

You may stop using Bubsby at any time. We may suspend or terminate access if you breach these Terms, create security, legal, operational, or safety risk, fail to resolve payment for a paid plan, if required by law or a third-party platform, or if we discontinue the Service.

Where practical and appropriate, we will give notice and an opportunity to resolve the issue. We may act immediately for urgent security, legal, or safety reasons.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the app, by email, through the website, or by another appropriate method. Continued use after updated Terms take effect means you accept the updated Terms.

20. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia, unless mandatory laws in your location require otherwise. You and Bubsby agree to first try to resolve disputes informally by contacting info@bubsby.com.

If a dispute cannot be resolved informally, courts located in New South Wales, Australia will have non-exclusive jurisdiction, except where applicable consumer laws give you the right to bring a claim in your local courts or prevent this jurisdiction clause from applying.

21. Regional Notes

If you are in Australia, New Zealand, the United Kingdom, Canada, or the United States, mandatory local consumer laws may give you additional rights. These Terms are intended to operate alongside those rights, not replace them.

If you are in Quebec or another province, state, country, or territory with specific consumer language, cancellation, renewal, refund, or dispute rules, those mandatory rules apply to the extent required by law.
